| Indian realtor fined for harrassing UK NRI over flat |

The National Consumer Commission of India has slapped a fine of Rs 50,000 (approx. £670) on a property dealer for harassing a UK-based NRI by not handing over possession of a flat on time. The commission also directed the property dealer to refund the amount of Rs 5.25 lakh (approx. £7,000) alongwith interest to the NRI after holding the realtor guilty for deficiency in service. Binata Debnath, the complainant, had paid an amount of Rs 5.25 lakh in 1997 to Jayant Dasgupta, who assured Debnath that he would hand over to him a fully-furnished flat in Kolkata by 1998. Binata wanted to buy a residential accomodation in Kolkata to settle down in her hometown with her husband after their retirement. But when the flat could not be delivered on time as the residential project failed to take off, Binata decided to cancel the booking of the flat and sought refund along with interest. After getting no response from the property dealer, she approached the state commission. The state commission decided the case in her favour. However, the property dealer then approached the National Consumer Commission which upheld the verdict. "We have no hesitation in holding the appellant, Jayant Dasgupta, guilty of gross deficiency in service as well as repeated misrepresentation amounting to unfair trade practice," said R C Jain, presiding member of the commission. - TNN.
